Supplemental Privacy Notice for California Residents

If you are a California resident, California law provides you with specific rights regarding your Personal Information. This Supplemental Privacy Notice for California Residents (the “CA Notice”) applies solely to residents of the state of California (“Consumers” or “you”) with respect to Personal Information Dynatrace processes as a business and supplements the information contained in Dynatrace’s Privacy Notice (the “Notice”). In the event of a conflict between this CA Notice and the Notice, this CA Notice shall take precedence for California residents. Any capitalized terms not defined in this CA Notice, or the Notice have the meanings set forth in the California Consumer Privacy Act of 2018 (the “CCPA”), as amended by the California Privacy Rights Act (the “CPRA”). These disclosures do not reflect our collection, use, or disclosure of California residents’ personal information, or data subject rights, where an exception or exemption under the CCPA applies.

At or before the time of collection, California residents may have a right to receive notice of our privacy practices, including the categories of personal information to be collected, the purposes for which such information is collected or used, whether such information is “sold” or “shared” and how to opt-out of such uses, and how long such information is retained. CA Notice
The CCPA provides California residents with the right to know what categories of personal information we have collected about them, and whether we disclosed that personal information for a business purpose (e.g., to a service provider), whether we “sold” that personal information, and whether we “shared” that personal information for “cross-context behavioral advertising” in the preceding 12 months. The categories of sources from which we collect personal information and our business and commercial purposes for using personal information as described in the Notice under “Personal Information We Collect”, “How We Use Your Information”, and “How We Disclose Your Information” above, respectively. We will retain personal information in accordance with the time periods set forth in “Data Retention”.
Your Privacy Rights
As a California resident, you have the following rights under the CCPA:
- Right to know which categories of personal information we have collected about you, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we collected about you (data portability right). You may only exercise this right twice within a 12-month period.
- Right to delete personal information we collected from you and retained, subject to certain exceptions.
- Right to opt-out of the “sale” or “sharing” of your personal information (as “sell” and “share” are defined by the CCPA). While Dynatrace does not sell your Personal Information, we may engage in “sharing” under the CCPA, which broadly defines this term as disclosing personal information for purposes of cross-context behavioral advertising, which is defined to include instances where companies target advertising based on personal information obtained from a consumer’s activity across distinctly branded websites or services. To opt-out of the “sharing” of your Personal Information for “cross-context behavioral advertising”, please click "Cookies" in the footer of any page, submit a request at Privacy Request Form, or contact us as described below.
- Right to correct inaccurate Personal Information Dynatrace holds about you, subject to certain exceptions.
- The right to limit our use and disclosure of sensitive personal information to purposes specified in Cal. Civil Code 1798.121(a). We do not use or disclose sensitive personal information for purposes other than those specified in Cal. Civil Code 1798.121(a).
- Right not to be subject to automated decision-making. You have the right to request information about the logic involved in automated decision-making and a description of the likely outcome of processes, and the right to opt out. Dynatrace does not currently engage in any automated decision-making practices.
Disclosure Regarding Individuals Under the Age of 16. Dynatrace does not have actual knowledge of any “sale” of personal information of minors under 16 years of age. Dynatrace does not have actual knowledge of any “sharing” of personal information of minors under 16 years of age for “cross-context behavioral advertising.”
Disclosure Regarding Sensitive Personal Information. Dynatrace do not use and disclose sensitive personal information for purpose of inferring characteristics about individuals.
Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
Exercise Your Privacy Right. If you are a California resident and would like to exercise any of your rights under the CCPA, please complete and submit a Privacy Request Form or contact us as described below. We will process such requests in accordance with applicable laws. We will not charge a fee to process or respond to a request, provided that you make no more than two (2) requests per year in any given twelve (12) month period. We may determine that your request warrants a fee if we believe your request is excessive, repetitive, or unfounded, we will provide you an explanation of the decision and a cost estimate before completing your request.
Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. To authorize an agent, please contact us as set forth in “Contact Us” below, provide written authorization signed by you and your designated agent and ask us for additional instructions.
Verification. To protect your privacy, we will take the following steps to verify your identity before fulfilling request submitted under the CCPA. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to provide your full name, e-mail address, company name, and any Dynatrace account numbers and usernames you may have. If we cannot initially verify your identity, we may request additional information to complete the verification process. Any personal information you disclose to us for purposes of verifying your identity will solely be used for that purpose.
Accessibility. This Privacy Policy uses industry-standard technologies and was developed in line with the World Wide Web Consortium’s Web Content Accessibility Guidelines, version 2.1. If you wish to print this policy, please do so from your web browser or by saving the page as a PDF.
“Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
